第５３９回 The present conditions of the Japanese constitutional state

　　　　　　　　I watched a news program of the ”Documentary Sengen”　 and intended by chance. 私も翻訳こんにゃくで…。
これとは逆の例も多々ありますよね。片側からしか物を見れない人が増えた現代、自分が加害者にも被害者にもなりうる可能性が多々ありますからねぇ。怖いことです。裁判員制度が今はとてつもなく怖いです。
テレビを見て適当に「こいつは死刑だな」って言えちゃう様な人が多いから…。

これはですね～　人権宣言６０周年を記念しての記事なんです。　簡単に言えば「日本は法治国家ですが、その法を全て刑法と思っている人が実に多い、法治国家の言う所の法とは憲法の事なんですよ　自由権が今日本では危うい」　その様な過ちが今の日本で見受けられるという世界へ向けての発信記事です。　これは高知県で起きた事件をたまたまTV（ドキュメンタリー宣言）を見ていて強く思った事です。

日本は「憲法」がありますから「法治国家」のはず・・・　なのですが。　警察がらみの裁判は日本では絶対敗訴しますね。　「踏み字」事件もそうですが、あまりにも信じられない事ばかりで唖然とします。　組織のメンツを保つ為なら証拠も捏造する・・・。　これでは「法」は意味をなしません。　日本の場合三権分立は実質上していませんし、裁判官も検察との関係上明らかに警察側が黒でも白としか判決が出せない現状があります。
最近警察への協力が減っていると言っていますが、こういう実情があったら当たり前です。　協力者が犯罪者にされかねませんから。　触らぬ神に祟り無しって誰も気が付いている証拠だと思いますね。

そうなんです！　適当に「死刑」と言うのが危ないんです。　死刑とは人を殺す訳です。　個人が人を殺したら許されませんが、皆が殺すのをOK！　と言えば人を殺していい訳です。　勿論これは極論ですが・・・。
本文でも書いてある通り最近日本では「冤罪」が多いんです。　サンディープロジェクトでも最近話題にしていますが。　僕としての見解は本文の通り「オウム真理教事件」からやたら「冤罪」が増えたと見ています。　
日本人はどこかヒステリックというか、冷静に物事を判断出来ない性質が多かれ少なかれ見られます。　　　「法」は最終手段で常用手段では無いとちゃんと日本国憲法に書かれています。　何でも「法」で罰せれば良いと言う人が一番危ない素質を持っている可能性は高いです。
